These Terms and Conditions (the “Terms”) govern your use of the services provided by GoBIG Systems, Inc. (“GoBIG Systems,” “we,” “our,” or “us”), including the MyPerfectSite™ application. By engaging with our services, you agree to these Terms. Please read them carefully.
1. Payment and Refund Policy
1.1 Refunds
Payments for services are refundable only if the service has not begun. For example, monthly services starting on the 10th of each month are not eligible for a refund after the 10th.
1.2 Month-to-Month Services
All GoBIG Systems services are month-to-month, or annual where selected, and can be cancelled in writing by mail or email before the monthly or yearly renewal date.
1.3 Late Payments
Payments must be made on time to avoid service interruptions. Late payments may result in suspension of services until payment is received.
2. The MyPerfectSite™ Application
2.1 What the application does
MyPerfectSite™ measures how your business appears in local search, audits the pages on your website against a published standard, and produces a plan of work for you to carry out. It is a tool you operate yourself. Where you have asked us to do the work for you, that is a separate done-for-you engagement with GoBIG Systems and is governed by the agreement covering it.
2.2 Your accounts and connections
You may connect third-party accounts you control, such as Google Search Console. You are responsible for having the authority to connect any account you connect. You can disconnect at any time from within the application. How we handle data obtained through those connections is set out in our Privacy Policy, and connecting is optional.
2.3 No guarantee of rankings
Search engines decide what to rank and change how they do so without notice. We do not control, and cannot guarantee, any particular ranking, volume of traffic, number of enquiries or level of revenue. Figures shown in the application are measurements and estimates from third-party sources, including Google, and are provided as they are reported to us.
2.4 Fair use
Plan limits — searches tracked, pages audited, map locations, reports and connected sites — are stated in the application and may be changed with notice. You agree not to attempt to circumvent them, to resell access to the application, or to use it to interrogate systems you do not own or have permission to analyse.
3. Brand Representation
3.1 Consistency with Existing Offerings
We will represent your brand and company in a manner consistent with your existing offerings.
3.2 Updates
Requests to update your content, campaigns or services will be addressed promptly, though processing times vary with the complexity of the request.
4. Telephone Numbers
4.1 Porting and Ownership
Telephone numbers provided by GoBIG Systems for your business can be ported or transferred into your name on request. Ownership requires compliance with the policies of the relevant service provider.
5. 10DLC Registrations
5.1 Customer Name Registration
All 10DLC registrations are conducted in the name of our customer. This ensures each campaign carries its own reputation and does not affect the operations or reputation of others.
5.2 Campaign Compliance
Customers are responsible for ensuring their campaigns comply with all applicable laws, regulations and carrier requirements.
6. Email and Mail Services
With the exception of temporary email services (a maximum of 60 days from account creation) and subscription-based third-party email, GoBIG Systems does not host customer email.
6.1 Third-Party Providers
Mail services are facilitated by third-party email providers.
6.2 Customer Responsibility
Customers are responsible for maintaining payment and security within their own email service accounts. Any breach, loss or non-payment associated with an email account is the sole responsibility of the customer.
7. Intellectual Property
7.1 Ownership
All content, designs and campaigns created by GoBIG Systems remain our intellectual property unless explicitly transferred to the customer in writing. The MyPerfectSite™ application, including its scoring methods and page standard, remains ours in all cases.
7.2 Your Data
The data about your business — your rankings, your page scores, your search history and the work you record — is yours. You may export it, and you may ask us to delete it, as set out in the Privacy Policy.
7.3 Limited License
Customers are granted a limited, non-exclusive licence to use the materials provided as part of the services. Unauthorized distribution or modification is prohibited.
8. Termination of Services
8.1 Grounds for Termination
We reserve the right to terminate services if:
- Payments are not made on time.
- The customer violates these Terms.
- There is evidence of misuse or illegal activity associated with the account.
8.2 Customer-Initiated Termination
Customers may terminate their services at any time by providing written notice by mail or email.
8.3 What Happens to Your Data
On termination we retain your data for 90 days so that it can be exported or the account reinstated, after which it is deleted. You may ask for immediate deletion at any point.
9. Limitation of Liability
GoBIG Systems is not liable for:
- Losses resulting from delays, interruptions or errors caused by third-party providers, including search engines and data vendors.
- Damages arising from misuse or unauthorized use of the services.
- Indirect, incidental or consequential damages related to the performance of our services.
10. Confidentiality
We will protect your confidential information in accordance with our Privacy Policy. You agree to do the same with any proprietary information we share during the course of our engagement.
11. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any dispute arising from these Terms will be resolved in the state or federal courts located in Tulsa County, Oklahoma, and both parties consent to that jurisdiction.
12. Amendments
We reserve the right to amend these Terms at any time. Updated terms will be posted on our website with the Effective Date revised accordingly. Continued use of our services constitutes acceptance of the revised terms.
